
COURSE TERMS AND CONDITIONS
Scope of Application
1. These General Terms and Conditions apply to every course conducted by Activgastro Gonzalez. Valid from: December 2024.
Registration and Payment of Course Fees
Oral or written registration obliges you to pay the course fee. Failure to pay the course fee does not constitute a cancellation. The course fee must be paid in full before the course begins.
Course Organization / Force Majeure
For organizational reasons, Activgastro Gonzalez reserves the right to reschedule or merge courses, change the location, or shorten courses with a proportional refund of the course fee. If a course instructor is unavailable, Activgastro may appoint a substitute or change the instructor. Activgastro Gonzalez also reserves the right to convert classroom instruction into remote learning under the same conditions if classroom instruction can no longer be maintained.
Course Places and Implementation
To ensure courses are conducted under optimal conditions, Activgastro sets a participant limit for each course offering, which may be adjusted if necessary. Course places are allocated in the order of registration (subject to timely payment). If there is an insufficient number of participants, the course will generally not take place, and the course fee will be waived or refunded.
In cases of insufficient participation, Activgastro may, with the consent of the participants, conduct the course with an adjusted course fee or, where appropriate, reduce the number of lessons while maintaining the same price.
Course Exclusion
Activgastro reserves the right to exclude one or more participants from a course for justified reasons. In the following cases, the full course fee is due, meaning there will be no partial refund or waiver of the course fee: exclusion due to non-payment of the course fee, and in severe cases (defamation, harassment, intentional property damage, etc.)
Cancellations
All cancellations must be submitted in writing. Depending on the timing of the cancellation, Activgastro may waive all or part of the course fee according to the following policy:
More than 48 hours before the course begins = Free of charge
Less than 48 hours before the course begins = 50% of the course fee
After the course starts: No waiver or refund of the course fee.
* Free cancellation is possible if unforeseen, serious circumstances arise. These include:

Death: A death in the immediate family (e.g., parents, siblings, spouse, children). A corresponding proof (e.g., death certificate) may be required.

Serious emergency:An unforeseen emergency that makes participation in the course impossible, such as a severe illness, accident, or other exceptional circumstances. A medical certificate or equivalent proof may be required.
In these cases, the full course fee will be refunded or, at the participant's request, credited towards a future course.
Rescheduling
Rescheduling can be done free of charge up to at least 24 hours before the course begins, always to the next available course date.
Course Confirmation
After successfully attending the course, Activgastro will gladly issue a course confirmation.
Confidentiality
1. The parties exchange information regarding existing or potential future collaboration. This may involve disclosing business and trade secrets, as well as other confidential information, both orally and in writing. The parties are obligated to maintain confidentiality, especially with regard to the customer's business secrets. Upon the customer's request, Activgastro is required to sign a separate non-disclosure agreement.
Data Protection
1. The collection and processing of personal data by the contractor and their service partners are carried out in strict compliance with the provisions of data protection laws.
2. Data will not be disclosed to third parties or sold to third parties in any way.
3. Data will only be shared with our distribution partners and service providers to ensure the proper delivery of services.
Disclaimer / Insurance
For all courses and events organized by Activgastro Gonzalez, Activgastro Gonzalez excludes any liability for damages incurred. Each course participant is responsible for ensuring they have sufficient insurance coverage. Activgastro Gonzalez cannot be held liable for theft or loss of personal belongings.
Each course participant agrees to comply with the current hygiene regulations of the Federal Office of Public Health (BAG) as well as the instructions of the event venue.
Access to the premises (including partner locations, external workshops, and premises rented to other companies) is prohibited for participants exhibiting symptoms of illness, suspected of being infected with transmissible pathogens, and/or subject to quarantine (either imposed by authorities or self-imposed). The risk of infection cannot be fully excluded even when hygiene regulations are followed. Activgastro Gonzalez disclaims any liability in this regard.
Jurisdiction and Severability Clause
1. Applicable Law: Swiss law
Jurisdiction: District Court of Andelfingen, Zurich
2. Should any provision of these Terms and Conditions be or become invalid, this shall not affect the validity of the remaining provisions. The invalid provision will be replaced by one that the parties would have agreed upon had they known of its invalidity.
Remaining Provisions
1. The company Activgastro may change the Terms and Conditions at any time. The client will be notified immediately of any changes.
2. The most current version of the Terms and Conditions is available on the website. The version published online is the valid one.
